Understanding Child Custody Issues

September - 13 - 2012 Reporter: Sandra Respond

Sometimes through divorces, separations or physical incapacities, issues such as child custody, support or visitation rights must be determined. A common misconception is that courts are likely to grant unreasonable custody arrangements, unrealistic visitation access or copious amounts of financial support awards to one party unfairly. In reality, courts have broad discretion in tailoring these orders, primarily taking into consideration the child’s best interests. According to Kansas state law, the court may order the joint legal custody of a child with both parties. In that event, the parties shall have equal rights to make decisions in the best interests of the child. Or, the court may order the sole legal custody of a child with one of the parties when the court finds that it is not in the best interests of the child that both of the parties have equal rights to make decisions pertaining to the child.

Behind the Story: Heartbreaking Child Homicide Investigation Interview

September - 13 - 2012 Reporter: Sandra Respond

I never imagined I would pressure a grieving family member into giving me an interview. But I was desperate. My deadline was looming and there was still an important piece missing from my story: An interview with the aunt of a young boy who was beaten to death. His aunt’s name is Katrina and she had agreed to meet me at the cemetery where little Christopher was buried. Then she stood me up. I really needed this interview. Finally a few days later, I gathered the strength to pick up the phone one last time. She didn’t answer, so I left a message telling her that I would be writing about Christopher’s death with or without her. I wanted to do the story justice, but for that, I needed her. A few minutes later, she sent me a text…

September - 13 - 2012 Reporter: Sandra Respond

BUFFALO, NY—U.S. Attorney William J. Hochul, Jr. announced today that James S. Allen, 36, of New Baltimore, Michigan, has been arrested and charged by criminal complaint with cyber-stalking, trafficking in computer passwords, and making harassing telephone calls. The charges carry a maximum penalty of 10 years in prison and a $250,000 fine. Assistant U.S. Attorney Aaron J. Mango, who is handling the case, stated that according to complaint, between June 24, 2012 and August 14, 2012, the defendant utilized the Internet and text messages to communicate with at least 10 female victims in the Western District of New York, many of them minors, in an effort to obtain pornographic pictures of the minors. The complaint alleges that Allen would contact the victims and tell them that he found naked pictures of them on the Internet. The defendant then directed the victims to a specific website to view the pictures. In reality, the website was a front by which the defendant sought to surreptitiously obtain the victim’s private e-mail address and password—such a site is sometimes referred to by law enforcement as a “phishing” website.
