Waltham —District Attorney Gerry Leone has issued an arrest warrant for a 35-year-old Waltham fugitive on child rape charges, said Cara O’Brien, a spokeswoman at Leone’s office. Authorities say Marvin Espinoza, of 44 Harvard St., raped a 13-year-old girl more than once. A grand jury indicted Espinoza on Dec. 7, on charges of forcible rape of a child, indecent assault and battery on a child under the age of 14 (3 counts), and indecent assault and battery on a person over the age of 14, according to O’Brien. The Middlesex County Sheriff’s Office Metropolitan Law Enforcement Council have Espinoza on their list of “Most Wanted” suspects for the alleged rapes. Waltham police referred the case to Leone’s office in May, O’Brien said.
