Court: Statutory Rape Unconstitutional For Suspects Under 13
COLUMBUS, OH — The Ohio Supreme Court ruled that sexual activity between two children under the age of 13 without force or impairment cannot be defined as rape. In August 2007, a 12-year-old boy was accused of engaging in sexual acts with an 11-year-old boy in Licking County. A young witness said the older, taller boy would bribe the younger one with video games, but the conduct did not occur until the 11-year-old consented, according to the case background.
