Child Victims Act would remove statute of limitations for abuse victims

The Penn State football team takes on the Wisconsin Badgers this weekend, and Wisconsin lawmakers are hoping to use the Penn State child sex abuse incident that rocked the campus recently, to launch their own child sex abuse reforms. They’re hoping to pass the Child Victims Act that would wipe away the statute of limitations in these cases, and allow victims to prosecute their abusers.

Child exploitation stands out as one of the most horrific federal crimes that my office prosecutes. The violence involved and the vulnerability of the victims are unparalleled. Child exploitation goes far beyond the actual acts of sexual molestation against young people, frequently taking the form of child pornography. Memorializing acts of sexual assault in photographs or videos sold or traded makes child pornography a crime that is committed every time those images are viewed.

Having difficult conversations and asking tough, sometimes awkward questions — of your children and those whose care you put them in — is the key to helping protect kids from becoming victims of sexual abuse, experts say. “You have to be strong enough to overcome your fears about teaching your children about sex and their sexuality, so you can arm them with knowledge to arm themselves,” said Kimberly Steward, a Park Forest resident and facilitator for Darkness to Light, a national group aimed at ending child sexual abuse.

On the surface, the Penn State scandal would seem to be another example of an institution of trust failing in its moral obligation to protect children. In fact, what the tragic web of human actions and inactions behind this outrage really shows us is that child sexual abuse is close to the perfect crime. As the choruses of bloggers and essayists who have rushed to print in the last week have reminded us, perpetrators can rely on the majority of children to tell no one about their sexual abuse; most will carry the secret to their graves. Child molesters, especially trusted and respected adult authority figures like priests, coaches and teachers, gain control of their prey gradually rather than resorting to violent assault.

Fewer than four out of every 100 adults with memory impairment who wander away from home are able to return without assistance. “If not found within the first 24 hours, half will experience serious injury or death,” says Peter Reed, PhD, senior director of programs for the Alzheimer’s Association. The only reliable way to rapidly locate someone who has wandered is with the assistance of E-9-1-1 and law enforcement. Historically, law enforcement has incurred high expense to find a missing person and with the limited capabilities of existing technology. Wandering cases cost an average of $15,000 per search and traditionally require large numbers of law enforcement officials to physically span a wide geographic area in a race against the clock.

Ellen DeGeneres is “devastated” by the recent suicide of a Rutgers University student who was outed on the Internet, and says that “something must be done” about teen bullying. “This needs to be a wakeup call to everyone that teenage bullying and teasing is an epidemic in this country and the death rate is climbing,” DeGeneres says in a video taped at her studio.

Many State legislatures have enacted legislation to address infant abandonment and infanticide in response to a reported increase in the abandonment of infants. Beginning in Texas in 1999, “Baby Moses laws” or infant safe haven laws have been enacted as an incentive for mothers in crisis to safely relinquish their babies to designated locations where the babies are protected and provided with medical care until a permanent home is found. Safe haven laws generally allow the parent, or an agent of the parent, to remain anonymous and to be shielded from prosecution for abandonment or neglect in exchange for surrendering the baby to a safe haven.

Preventing Child Molestation

Child molestation is a disease. The child molester is a sick person with an illness that he is unable to control or stop on his own. He has a preoccupation and a sexual desire for young children. In order to stop, he needs help through treatment, supervision or incarceration. In our collective experience working with this population in the Jewish community, approximately one-third of pedophiles have a preference for boys, one-third prefer girls, and one-third have no preference. Some pedophiles also have distinct preferences within select age groups. And one predator may abuse dozens or hundreds of children. What can we — as parents, educators and a community — do to protect and respond to sexual abuse?
