CANYON COUNTY – Child pornography isn’t new, but between the internet and inexpensive, readily available recording equipment, it’s easier than ever for offenders to produce and distribute. Tracking, apprehending and prosecuting those who view child pornography is a complicated and, at times, overwhelming process. Horrific Case of Abuse, Murder

The Ontario ooroner has called an inquest into the death of Jeffrey Baldwin, 5.

Jeffrey Baldwin (20 January 1997 – 30 November 2002) was a Canadian child whose death from septic shock after years of mistreatment by his grandparents, Elva Bottineau and Norman Kidman, led to significant changes in policy by children’s aid societies in the granting of custody of children to relatives.  On 19 March 2003, his grandparents were arrested and charged with first-degree murder for their role in his death. The trial heard they had kept Jeffrey locked in a bedroom, where he lived in his own feces, and left him to drink from a toilet. The judge was told that the pair used the children as a source of income, collecting government support cheques while offering little in return. On 7 April 2006 they were convicted of second-degree murder by Justice David Watt in Ontario Superior Court. READ MORE HERE

Marlon Iverzander Lopez is wanted in connection with allegations of continual sexual abuse of six children over a span of several years, beginning in approximately 1997. A state arrest warrant was initially issued on September 28, 2002, by the Riverside Superior Court in California after Lopez was charged with 30 counts of lewd or lascivious acts with a child. He was located and arrested on March 12, 2005; however, after posting bond, Lopez failed to appear for subsequent court dates. A second arrest warrant was issued in Riverside Superior Court on August 15, 2005. Lopez was charged federally with unlawful flight to avoid prosecution and a warrant for his arrest was issued by the United States District Court, Central District of California, on July 17, 2006.  READ MORE HERE

Le Roy, N.Y.— Wednesday night, James Dupont attended a meeting at Le Roy Junior-Senior High School hoping to find some answers about what may be wrong with his daughter. Since the first week of December, his 17-year-old daughter suddenly had tics and showed signs of Tourette-like symptoms. But she isn’t the only one. Michael Ray White, 60, is being sought on a $1 million arrested warrant in an alleged assault on a 13-year-old Lancaster girl.  The following chart lists the unrestricted legal age of consent for each of the 50 states and DC. This means that at that age an individual can have sex with whomever they wish as long as that person is consenting and they are the same age or older. To have sex with someone under the age of consent is a strict liability crime (in most states) known as statutory rape. It is often referred to by other names such as sexual assault, sexual misconduct with a child, etc. In addition to the age of consent, the chart also indicates whether or not there is an age-gap provision for that state. Many states have age-gap provisions that legalize teen sexuality as long as they are within a certain age range. Other states have “affirmative defense” clauses. In all states, dating, hugging, holding hands and kissing are not illegal. In some states, fondling, groping through the clothes or other such things known as “3rd base” is illegal. ‘Sexual Offender’ Definitions

The Dru Sjodin National Sex Offender Public Website (NSOPW), coordinated by the U.S. Department of Justice, is a cooperative effort between jurisdictions hosting public sex offender registries (“Jurisdictions”) and the federal government and is offered free of charge to the public. These Jurisdictions include the 50 states, U.S. Territories, the District of Columbia, and participating tribes. The Website provides an advanced search tool that allows a user to submit a single national query to obtain information about sex offenders; a listing of public registry Web sites by state, territory, and tribe; and information on sexual abuse education and prevention.

 

SEX OFFENDER DEFINITIONS

943.0435  Sexual offenders required to register with the department; penalty.

(1)  As used in this section, the term:

(a)  “Sexual offender” means a person who meets the criteria in subparagraph 1., subparagraph 2., or subparagraph 3., as follows:

1.a.  Has been convicted of committing, or attempting, soliciting, or conspiring to commit, any of the criminal offenses proscribed in the following statutes in this state or similar offenses in another jurisdiction: s. 787.01, s. 787.02, or s. 787.025(2)(c), where the victim is a minor and the defendant is not the victim’s parent; chapter 794, excluding ss. 794.011(10) and 794.0235; s. 796.03; s. 796.035; s. 800.04; s. 825.1025; s. 827.071; s. 847.0133; s. 847.0135; s. 847.0137; s. 847.0138; s. 847.0145; or 1s. 985.701(1); or any similar offense committed in this state which has been redesignated from a former statute number to one of those listed in this sub-subparagraph; and

b.  Has been released on or after October 1, 1997, from the sanction imposed for any conviction of an offense described in sub-subparagraph a. For purposes of sub-subparagraph a., a sanction imposed in this state or in any other jurisdiction includes, but is not limited to, a fine, probation, community control, parole, conditional release, control release, or incarceration in a state prison, federal prison, private correctional facility, or local detention facility;

2.  Establishes or maintains a residence in this state and who has not been designated as a sexual predator by a court of this state but who has been designated as a sexual predator, as a sexually violent predator, or by another sexual offender designation in another state or jurisdiction and was, as a result of such designation, subjected to registration or community or public notification, or both, or would be if the person were a resident of that state or jurisdiction, without regard to whether the person otherwise meets the criteria for registration as a sexual offender; or

3.  Establishes or maintains a residence in this state who is in the custody or control of, or under the supervision of, any other state or jurisdiction as a result of a conviction for committing, or attempting, soliciting, or conspiring to commit, any of the criminal offenses proscribed in the following statutes or similar offense in another jurisdiction: s. 787.01, s. 787.02, or s. 787.025(2)(c), where the victim is a minor and the defendant is not the victim’s parent; chapter 794, excluding ss. 794.011(10) and 794.0235; s. 796.03; s. 796.035; s. 800.04; s. 825.1025; s. 827.071; s. 847.0133; s. 847.0135; s. 847.0137; s. 847.0138; s. 847.0145; or 1s. 985.701(1); or any similar offense committed in this state which has been redesignated from a former statute number to one of those listed in this subparagraph.

(b)  “Convicted” means that there has been a determination of guilt as a result of a trial or the entry of a plea of guilty or nolo contendere, regardless of whether adjudication is withheld. Conviction of a similar offense includes, but is not limited to, a conviction by a federal or military tribunal, including courts-martial conducted by the Armed Forces of the United States, and includes a conviction or entry of a plea of guilty or nolo contendere resulting in a sanction in any state of the United States or other jurisdiction. A sanction includes, but is not limited to, a fine, probation, community control, parole, conditional release, control release, or incarceration in a state prison, federal prison, private correctional facility, or local detention facility.

(c)  “Permanent residence” and “temporary residence” have the same meaning ascribed in s. 775.21.

(d)  “Institution of higher education” means a career center, community college, college, state university, or independent postsecondary institution.
