LITTLE ROCK, Ark. – A Salvation Army worker was shot and killed Christmas Eve in front of his three young children by a man who attempted to rob him outside the charity’s community center in North Little Rock, a Salvation Army official said Friday.

North Little Rock police said they were looking for the two men who accosted Salvation Army Maj. Philip Wise outside the community center about 4 p.m. Thursday. No arrests have been made.

Wise, 40, had gone to the community center with his children to pick up his wife — also a Salvation Army major — to drive to his mother’s home in West Virginia, said Maj. Harvey Johnson, area commander of Salvation Army. As Wise neared the side door, two men approached.

Both men were carrying hand guns, police said. One demanded money and shot Wise, Pulaski County Coroner Garland Camper told the Arkansas Democrat-Gazette. Wise’s wife, Cindy, was inside the center and called 911.

Blood stained the sidewalk outside the center Friday.

The Wises had just adopted their children — ages 4, 6 and 8 — last year, Johnson said. The three were siblings who came from an abusive family. They were receiving counseling after their father’s death, he said.

Wise had worked for three years in Baring Cross, a low-income neighborhood troubled by gangs and drugs, Johnson said. He ran youth programs, a food pantry and church services.

“He was involved in the fabric of that community in a lot of different ways,” Johnson said.

He described Wise as “a big boy” who played “a big old tuba” in a brass ensemble and used his love of music to try help others.

“He encouraged kids in music as an alternative to the life they were living,” he said.

Wise was originally from Weirton, W.Va., and his wife, Cindy, was from Charleston, W.Va. They met 16 years ago at a Salvation Army school in Atlanta, Johnson said. Both had worked for the Salvation Army ever since.

“He’s touched a lot of people,” Johnson said. “But who would he have touched if he had been able to live out his career?”

PHOENIX – When Phoenix police officer Mike Burns pulled near a brown pickup he suspected the two people inside were a kidnapper and his 5-year-old victim. When the truck raced off, he was sure.

“There was no doubt in my mind,” Burns told reporters on Saturday, several hours after the little girl was rescued. “If he disappears, we may not get her back.”

Determined not to let the truck out of his sight, the patrolman set out on a Christmas night car chase through the streets of north Phoenix that ended after 10 minutes in the arrest of 45-year-old Larry Jon Ladwig.

The frightened girl was taken to a police facility that aids young victims of crime, where it was determined she had been molested. The girl was treated and is back home with her family, police Sgt. Andy Hill said Saturday.

Ladwig was booked into jail on charges of kidnapping, sexual molestation of a child, aggravated assault of a police officer and felony flight. It’s unclear whether Ladwig has a lawyer, and the Maricopa County Sheriff’s Office did not immediately respond to a request to interview him.

Hill said statistics show that if police don’t recover children abducted by strangers within the first several hours, “chances are slim of recovering them alive.”

“We really did have a Christmas miracle,” he said.

The girl was rescued at about 9:30 p.m. Friday, more than seven hours after police allege that Ladwig kidnapped her while she was playing outside a Phoenix apartment building.

The Associated Press is not reporting the girl’s name because she may be the victim of a sex crime. The AP had named the girl after her abduction and an Amber alert was issued.

When Burns’ spotted Ladwig’s pickup, he alerted the force. Officers put spike strips across the road several blocks away that punctured Ladwig’s tires, causing him to crash on the roadside.

Ladwig took off on foot but was caught and arrested a block away after a brief struggle during which Hill said he punched an officer in the face.

“It makes you feel good,” Burns said of his part in the girl’s rescue. “It takes a while to soak in.”

Police received the call that the girl had been taken at about 2:15 p.m. An Amber Alert was issued, and authorities began combing the area on foot, by car and with helicopters.

Hill said the child had been playing in a common area at the apartment complex with her two sisters, ages 7 and 9, when a man parked his brown pickup in a nearby parking lot and walked over to them carrying a camera.

He said the man violently pulled down the 7-year-old’s pants, took a photo of her, then grabbed the 5-year-old and threw her into the truck through a window.

“That’s pretty doggone violent,” Hill said. “He’s a weapon himself … (The girl) has got a lot to go through now. She’s not unscarred from this, obviously in a number of ways. She’s got a long road ahead of her.”

After the kidnapping, the 5-year-old’s older sister pounded for help on the door of a neighbor, who called police.

The three sisters live with an aunt, who has legal custody of them, Hill said. The girls’ parents live separately out of state.

I don’t know how I missed this story when the arrest happened because the dude’s name is DJ Skinny. How could I have missed that?

Anyway, DJ Skinny, aka 32-year-old Heath Edward Hill, was sentenced to 10 years in federal prison for soliciting sex and nude pics from underage girls.

Hill was a radio DJ in Shreveport, La., not one of those other DJs, and used his position to bribe underage girls on MySpace for nude pics by promising them concert tickets from the radio station. However two girls turned control of their MySpaces over to the Northwest Louisiana Crimes Against Children Task Force. D’oh.

Parents pose as their 11-year-old daughter to snare Facebook paedophile grooming her for sex:

52-year-old Thomas Gibbs of England was sentenced to a mere 16 months for soliciting an 11-year-old girl on Facebook.

Her parents noticed that their daughter was chatting with someone on Facebook who said he wanted to kiss her.

The parents took over the chat and Facebook profile and lured out Gibbs into the open.

Along with the short sentence Gibbs will have to be on the British sex offender registry for only 5 years.

I’m sure that such a “harsh” sentence will keep him from reoffending.

While I’m glad the parents were paying enough attention to catch this scumbag, an 11-year-old has no business being on Facebook.

Honor Student Severely Beaten By 11 Other Students

ENGLEWOOD, New Jersey – After accidentally hitting a girl with a basketball, 8th-grade honor student David Muneton was savagely attacked by up to 11 other students. He was beaten so severely that he will need reconstructive surgery on his face and the 13-year-old may even lose his sight.

Police have arrested seven students from both Dismus Middle School and high school, charging them with aggravated assault. The youngest one is just 12 years old.

The group jumped Muneton on a soccer field as he walked home from school. The reason for the attack was to get back at him for accidentally hitting a girl with a basketball earlier in the day.

The girl, who has also been charged, led the boys to Muneton, saying “He’s the one.”   He was then immediately punched by one of the boys.

Anthony Masucci Jr. Arrested For Child Porn

New Jersey State employee admits to downloading and sharing kiddie porn.

Bristol Township, PA – Anthony Masucci Jr, 29, has found himself behind bars on Christmas eve. The New Jersey state employee was arrested for possession of child porn, namely pre-pubescent females engaging in sexual acts, and the criminal use of a communication facility.

Police state Masucci has admitted to “downloading, viewing and sharing the child porn using his computer”, according to court records.


Masucci, who also goes by the name of Tony, is a newlywed. I ‘m going to assume the honeymoon is pretty much over. He employed as an insurance analyst for the New Jersey Department of Banking and Insurance… for now. Of course Tony has a MySpace. Anthony Masucci is now in Bucks County prison in lieu of $500,000 bail. That will be a cool 50 large to bond him out. Merry Christmas Tony, enjoy that fake turkey slice along with a glob of crap that they pass off as stuffing.

Glenn Klusendorf Leads Cause To Virginia’s Theory

“We knew where he was, but we weren’t aware he was going to be the Santa Claus”, say police:

A Texas man working as a Santa Claus was arrested and charged Thursday with indecency with a child following a lengthy investigation in which a young female acquaintance, now 13, had allegedly been sexually abused for years.

Glenn Roy Klusendorf, 45, of Houston, who played Santa at a local outdoors market, was taken into custody after the child reportedly told her mother what had happened.

Investigators say they are currently looking at a videotape confiscated at Klusendorf’s own mother’s home where he reportedly had been living at the time of his arrest.

The former Santa Claus is now residing at the Galveston County Jail on $60,000 bond and detectives are asking anyone with additional information to contact them at 281-334-1034.

Clinton Cheatham Arrested For Molestation Of Boy, 8

A 43-year-old Arizona man was arrested earlier this week on charges that he molested a little 8-year-old boy.

Prescott police say they booked Clinton Fletcher Cheatham, of Peeples Valley, on one count of child molestation, one count of sexual assault and one count of sexual conduct with a minor.

Man Charged In Rape Of MySpace Women

Suspect drugged then raped women, say police:

A Yorba Linda, California man has been charged with drugging then raping several women he met using MySpace.

Jason Ara Erpinar, 20, pleaded not guilty on two counts of using drugs to commit rape and one count of forcible rape.

Erpinar is accused of meeting an 18-year-old woman on MySpace and subsequently inviting her to a party where he allegedly raped her in a bathroom after giving her a drug that incapacitated her.

In another incident, police say Erpinar raped a 22-year-old woman at a hotel after meeting her on the social networking giant. The woman said she woke up the next day with a cracked tooth and scraped face.

A third victim is also alleged to be his ex-girlfriend, 17, who he reportedly raped “numerous times” between 2006 and 2007.

In convicted on all charges, Erpinar could face 45 years to life.

Erpinar’s MySpace has since been deleted.

MySpace Contact Leads To Charges

A 25-year-old Florida man was arrested last week after renting a motel room in order to perform sex acts with two underage girls.

Gilbert Hernandez, of Zephyrhills, is accused of communicating with at least one of the girls on MySpace where a subsequent “meeting” was arranged.

The incident is said to have taken place on October 24th at the Best Western Summer Crest in Wesley Chapel.

Hernandez was identified from a photo lineup and later taken to jail in lieu of $20,000.

Illegal Immigrant Apprehended In MySpace Sex Case

A 20-year-old illegal immigrant from El Salvador but residing in New Hampshire has been arrested after allegedly engaging in sexual activity with a 13-year-old girl he met using MySpace.

Wilfredo Cuellar-Mejia, of Nashua, faces 26 counts of felonious sexual assault after he was found to be in the girl’s home after she reportedly let him in.

Cuellar-Mejia was actually arrested by police following a frantic phone call to 911 after the parent’s suspected a burglary in progress at their home.

Investigators say he had been living in the U.S. illegally for about 3 years.

Christmas is supposed to be magical. A time of year that many people, especially children; look forward too. The holiday lights, the celebrations, drinking hot cocoa with those you love. Parents are busy tucking their children into bed waiting for the morning to come. Unfortunately that is not the case for some families. This story saddens my soul, and reins heavy on my heart.
Duke Lawrence Watrous, 36, of Denton County shot and killed his 10 year old daughter on Christmas Eve. Ashley Watrous was shot in the face, and passed away on their dining room table, according to the Star-telegram.

“The brother of the victim called authorities and said she had been shot by her father,” said Tom Reedy, a spokesman for the Denton County Sheriff’s Department. (Star-telegram) There are no other details of the shooting, as of now.

Watrous bail was set at $200,000.

“According to Denton County criminal court records, Watrous has an injury to a child charge pending against him. He was booked into the Denton County Jail on that charge April 1 and was released on bail the next day, records show.” (Star-telegram)

There are many questions I feel need answers too, some of them being;
Why, was this father allowed access to his children with pending injury to a child against him?
Why, were the children in the same home as him?
Who was watching over the children’s welfare and well-being?

VALENCTIA COUNTY–Woman indicted on charges of child abuse

A grand jury has indicted a Valencia County woman accused of a drunk driving crash that injured her daughter.

Hope Gallegos, 31, was indicted on charges of child abuse and aggravated driving while the under the influence. Gallegos remains in the Valencia County Detention Center on a $200,000 cash or surety bond.

Valencia County sheriff’s deputies arrested Gallegos on November 22 following a single-vehicle crash on N.M. 47 and Oakhurst. Investigators said Gallegos is believed to have run her truck off the roadway.

The truck struck a 20-foot-long steel fence post, which fell over onto the cab, crushing the child. The impact blew out the back, front and side windows on the truck.

Gallegos told police that she passed out following the crash, and when she awoke, she found her daughter smashed by the roof of her truck. The woman said she couldn’t find her phone, and no one would stop, so she picked up her daughter and walked to a nearby house, waking the residents.

The residents took her to the area where she met police. Her truck was heavily damaged in the collision.

She later told police she had been drinking with relatives in Albuquerque, but left against advice to stay because she wanted to spend time with her boyfriend.

Gallegos’ daughter was injured in the crash, but survived, and has since been released from the hospital.

Police found open containers of alcohol in the vehicle along with several prescription bottles, some of which were believed to contain pain killers, said Deputy Chris Trujillo.

He said Gallegos was treated on the scene and taken to the sheriff’s office where she had a blood alcohol concentration of .08 and .09, which left her at the presumed level of intoxication. Deputies administered the test about four hours after the collision.

WI–Charges expected in physical abuse of girl, 5

PORTAGE, Wis. – Charges are expected against a Wisconsin man accused of helping his girlfriend bind her young daughter to control her tantrums.

Police arrested the 37-year-old Columbus man Wednesday. They’re seeking multiple charges that include physical abuse of a child.

The girl’s mother is already charged with multiple counts related to child abuse.

The Reporter in Fond du Lac says the mother is accused of tying up the 5-year-old with rope and binding her mouth with duct tape when the girl acted up. The mother would then allegedly lock her in her bedroom.

The child tells police the woman’s boyfriend helped tie her up.

The girl now lives with her father in Tucson, Ariz. Her 12-year-old stepsister and 3-year-old sister are in foster care.

Fort Pierce man facing child abuse charges

FORT PIERCE — A 33-year-old Fort Pierce man is facing child abuse charges after hitting his two stepdaughters for turning the lights on while he was watching a movie, an arrest report states.

On Christmas, Fort Pierce Police Department charged Stacey McIntosh, of the 3000 block of Hibiscus Avenue, with felony cruelty toward a child without great harm and misdemeanor battery touch after he allegedly slapped his two 7-year-old stepdaughters, one in the face and the other on the arm.

According to the arrest report:

About 11:15 p.m., McIntosh was watching a movie in the living room when the girls came in to play with their Christmas toys and wanted to turn on the light. McIntosh repeatedly told them not to because he wanted to watch a movie with the lights off. However, the girls turned the lights on and that’s when McIntosh allegedly hit them.

McIntosh denied hitting the girls but said he was agitated the girls turned on the lights. Police said there were no visible injuries.

As of Saturday, he was in St. Lucie County Jail in lieu of $2,750 bail.

Police found the body today of an 11-year-old girl who was snatched from her Wicomico County, Md., bedroom Wednesday night, allegedly by a registered sex offender who is already under arrest in her disappearance.

Thomas J. Leggs Jr., 30, is charged with burglary and with kidnapping Sarah H. Foxwell, according to Wicomico County Sheriff Mike Lewis.

At a news conference late this afternoon, Lewis announced that Sarah’s body had been found at approximately 4 p.m., but gave few other details.

Thousands of people turned out on Christmas morning to help investigators search for the girl, police said.

Leggs was seen entering the girl’s bedroom late Wednesday night by her 6-year-old sister, who described the kidnapper down to the color of his shoes, police said.

“Sarah’s sister provided a complete description down to the color of his sneakers, jeans and jacket,” Lewis told ABCNews.com. “When we apprehended Lewis in his family home, he was wearing the same exact clothing the sister described.”

Local, state and federal investigators used dive teams to scour a lake, and also brought in sniffer dogs and helicopters. The most recent focus of their search was a 3-mile square area in Wicomico County, near the Delaware border.

Police even asked local residents to search their own “land, wooded areas, and leased parcels for hunting” and then tie a red ribbon on the mail boxes to indicate the property had been searched.

Leggs, a registered sex offender in Maryland and Delaware, “has been very uncooperative since the investigation was initiated,” Lewis said earlier today.

The Maryland registry lists him as a child sex offender, but does not details his crimes.

Leggs was a former boyfriend of Foxwell’s aunt, the girl’s legal guardian and the owner of the home from which she was allegedly kidnapped. He was being held at the Wicomico County Detention Center without bail.

“She was not in her room the next morning,” Lewis said. “There were no signs of forced entry.”

When Sarah disappeared, the brown-haired, blue-eyed girl was wearing red fuzzy pajama bottoms with Christmas trees on them and a pink John Deere T-shirt.

SALISBURY, Md. -The body of a Maryland girl who authorities say was abducted by a registered sex offender was found Friday in a wooded area near the Delaware state line after thousands of volunteers spent Christmas searching for her.
Wicomico County Sheriff Mike Lewis said the body of 11-year-old Sarah H. Foxwell was discovered about 4 p.m. He offered few other details. Thomas J. Leggs Jr., 30, was arrested Wednesday and charged in her kidnapping.
Wicomico County State’s Attorney Davis R. Ruark said authorities remain focused on Leggs as they investigate the killing.
“There’s no indication of involvement of any other individuals at this point,” he told The Associated Press.
Leggs is a former boyfriend of the girl’s aunt, who is her legal guardian. A public defender representing him has not returned a phone call.
Lewis said the body was found in the northern part of the county, in the area where authorities had been focusing their search.
“This is not the way we wanted to find our young lady on Christmas, but at the very least we’ve given closure to the family,” Ruark said at the news conference.
Lewis said Sarah was last seen Tuesday night at her home on Maryland’s Eastern Shore. A relative discovered she was missing early Wednesday while checking on Sarah and her 6-year-old sister. A charging document says Leggs was the last person seen with Sarah.
A “juvenile witness” awoke during the night Tuesday and saw Sarah leave the bedroom with “Tommy,” and said he was wearing blue jeans, an orange jacket and white sneakers, the charging document says.
Sarah lived with her aunt, Amy Fothergill, who told police the child’s toothbrush was missing from the home, according to the statement of probable cause.
Deputies said they found a green toothbrush and a lollipop in a truck Leggs admitted driving. Leggs said he had been wearing jeans and white sneakers the previous night — the same clothes he was wearing when police questioned him.
The sheriff said Thursday that Leggs has been uncooperative and “of no assistance to our investigators.”
Leggs is listed on the Maryland and Delaware sex offender registries. The Maryland listing notes that he is a child sex offender, but does not give details about his conviction.
Lewis said Leggs has been convicted of a sex offense in Wicomico County and was charged Oct. 29 with fourth-degree burglary.
In 2001, Leggs was convicted in Delaware of rape involving a victim who was 16 or 17, according to the Delaware registry. The registry describes his risk level as “high” and notes he is unemployed.
Leggs, who has been convicted of assault several times, also is awaiting trial on charges of burglary and destruction of property in Ocean City.
Thousands of volunteers had gathered at a stadium in Salisbury early Friday morning and fanned out to search for her.

An Apple Valley couple are wanted in connection with the prolonged torture of a 5-year-old boy, according to San Bernardino County sheriff’s officials.

“The abuse took place over a five-month period, during which the child was burned with a heated spoon and a glue gun, as well as deprived of food and water,” investigators say in a wanted flyer. “The child was also sexually molested.”

Arrest warrants — with $1 million bails — name 32-year-old Martin Roland Morales and 28-year-old Crystal Pauline Rodriguez as the suspects. The charges are torture, child abuse and false imprisonment.

Morales is a gang member who gave his brother’s name to avoid arrest during the initial investigation, deputies say.

“Morales told investigators … that he would ‘shoot it out’ (if) they tried to arrest him,” according to the flyer.

He is 5-feet-11, 280 pounds and has the names of his daughters tattooed on the sides of his head, with praying hands on the back of his head. He and Rodriguez are believed to have left for Los Angeles.

APPLE VALLEY — Authorities are searching for two suspects accused of physically, mentally and sexually torturing a 5 year old boy over a five month period.

$1 million arrest warrants have been issued for Martin Roland Morales (aka “Bullet”), 32, and Crystal Pauline Rodriguez, 28, who disappeared after they were contacted by authorities investigating reports of child abuse, according to San Bernardino County Sheriff’s spokeswoman Arden Wiltshire. Authorities believe the couple may be in Los Angeles county.

The boy’s mother and a 16 year old roommate were arrested in August after an anonymous tip was called in to the county’s child abuse hotline.

Sheriff’s deputies say the boy was burned with heated spoons and a glue gun, as well as deprived of food and water. The child was also sexually molested by Morales and other Males at an Apple Valley residence where Morales and Rodriguez were living, investigators say. He has been placed in foster care.

One handgun was recovered from the residence, and several other firearms are still outstanding.

Morales is an Eastlake Gang member, deputies said, and gave his brother’s name during the initial investigation to avoid arrest.

He told investigators he would “shoot it out” with law enforcement if they tried to arrest him, and is considered armed and dangerous.

Morales is described as a Hispanic male about 5’11″ and 280 pounds. He has tattoos of his daughters’ names on the left and ride side of his head and praying hands on the back of his head.

Rodriguez is a Hispanic female about 5’01″ and 130 pounds.

ATLANTA — Officials have no idea where nearly 250 metro Atlanta sex offenders are.The Atlanta Journal-Constitution reports nearly one-tenth of the area’s registered sex offenders who are not in jail are listed as “absconded.”

That means law enforcement authorities has lost track of them, despite a strict law intended to keep such offenders under close supervision and away from potential victims.John Bankhead is a spokesman for the Georgia Bureau of Investigation, which maintains the sex offender registry.

He said the long list of people on the registry are not the ones to be concerned about. He said the concern lies mostly with unspotted predators not yet on the list.

A Columbia mother is behind bars after allegedly using excessive force to spank two of her three children.

Adrienne Witherspoon, 30, was arrested and charged Thursday with two counts of aggravated child abuse.

Maury County Sheriff’s Detective Terry Chandler said authorities were alerted to the alleged abuse after one of the children approached a school resource officer at E.A. Cox Middle School.

Two of the children, who are 8 and 10 years old, had visible bruises on their chest, back and arms, according to an arrest warrant. One of the children told authorities his brother had also been beaten.

The warrant states Witherspoon used a belt to repeatedly strike both children.

“They were overspanked,” Chandler said.

Witherspoon’s children, including a 5-year-old, are now in protective custody with the Department of Children Services, Chandler said.

Aggravated child abuse is generally considered a Class B felony, unless the victim is 8 years old or younger or otherwise physically or mentally handicapped. Because one of the alleged victims is 8 years old, one of the abuse charges counts as a Class A felony, according to state law.

She remained jailed Friday in lieu of $20,000 bond.

    CEDAR CITY, Utah (ABC 4 News) – A baby is on life support after police say his father seriously injured the boy.

    The father, 25-year-old Andy Roy Gorecki has now been charged with intentionally injuring a child, which is a second degree felony.

    The two-month-old was taken to the hospital over the weekend. When it appeared that he had stopped breathing police began questioning Gorecki about the injuries. Officials then booked him into the Iron County jail.

    Gorecki has been previously convicted as a sex offender.

    MILLER COUNTY, MO. — The Miller County Sheriff’s Department has arrested a man who allegedly abused his two children.

    James Sprague Jr. is arrested for first degree assault and child endangerment.

    Investigators said he smoked marijuana in front of his kids who are 14 months and 2 months old.

    Sprague is also suspected of fracturing his 2-month-old’s legs.

    He is being held in the Miller County Jail without bond.

    A Sandy man has admitted killing a 9-month-old infant while baby-sitting earlier this year.

    Jared Daniel Billette, 23, was charged in 3rd District Court with first-degree felony murder in connection with the October death of Milo Doxey.

    Billette pleaded guilty Monday to first-degree felony child-abuse homicide, which is punishable by five years to life in prison. The murder charge is punishable by 15 years to life.

    Sentencing is set for Feb. 1 before Judge Mark Kouris.

    Billette, who initially denied that an accident or abuse occurred, said while entering his plea hearing that he was swinging the child when the child’s head hit a hard surface, according to prosecutors.

    Charging documents say that Milo’s mother, Samantha Hanson, dropped her son off at Billette’s apartment around 3:30 a.m. on Oct. 7.

    The mother occasionally had been leaving the baby with Billette and his girlfriend, Brianna Cottrell, 21.

    Billette and Cottrell awoke at 8:30 a.m. when a 2-year-old girl was dropped off for them to baby-sit. Cottrell then left for work, leaving both children in Billette’s care, charges state.

    When Cottrell called Billette around 11:15 a.m., Billette told her Milo was unresponsive. Cottrell returned to the apartment, found Milo was not breathing and called 911 and the boy’s mother.

    The child was flown by helicopter to Primary Children’s Medical Center where he died the next day.

    An expert in abusive head trauma in infants found Milo suffered a “massive, global brain injury,” which was likely caused by “a combination of severe rotational forces and massive impact to the head,” charges state.

    The trauma could only have been carried out by a person with “adult strength” and could not have been caused by an accident, the expert told police.

    A pediatric neurosurgeon who operated on Milo’s skull to relieve swelling in hopes of saving his life called the injuries “the worst case of an inflicted brain trauma in a child” he had ever seen, charges state.

    Billette, who is from Washington state, had been living in Utah with Cottrell for about a month, police have said. Cottrell was a friend of Milo’s mother.

    Billette and Cottrell had recently started baby-sitting to bring in extra money, but weren’t formal day care providers, police said.

    American Academy of Pediatrics Issues Policy Statement on HIPAA and Child Abuse

    December 22, 2009 — The Committee on Child Abuse and Neglect of the American Academy of Pediatrics has issued a new policy statement to guide pediatricians through the federal Health Insurance Portability and Accountability Act (HIPAA) regulations regarding their responsibilities in releasing or reviewing patient health information without knowledge or consent when child abuse or neglect is suspected.

    The policy statement, which recommends that pediatricians become familiar with their state laws and HIPAA regulations, appears in the January issue of Pediatrics and was published online December 21.

    The committee writes that HIPAA has significantly affected clinical practice, particularly with regard to how patient information is shared. It addresses the security and privacy of patient health data to ensure that information is released appropriately and with patient or guardian consent and knowledge.

    However, HIPAA permits disclosure of information without the consent of a legal guardian in matters that relate to abuse, neglect, public health, and safety of children.

    All states mandate that physicians report suspected cases of abuse or neglect to the appropriate agencies, which in most states include child protective services and law enforcement agencies.

    The committee recommends that pediatricians become familiar with their state laws in this regard and for them to also know when HIPAA or state laws take precedence. They should know which agencies are authorized to receive and investigate reports of child abuse and the laws that govern release of protected health information after investigation.

    Highlights of the recommendations include the following:

    • The pediatrician must report and may disclose a child’s protected health information to child protective services and law enforcement agencies without parental consent.
    • When abuse has been reported and is being investigated, the pediatrician may disclose information to appropriate investigative agencies without notifying the parent, or without the parent’s consent.
    • The pediatrician must try to inform the parent that such disclosures have been made, unless doing so could endanger the child.
    • The pediatrician must recognize situations that require disclosure of information immediately, and in which delay might jeopardize the child’s safety.
    • The pediatrician can withhold the child’s information from the parent if the parent is the abuser, or if the parent is protective of a suspected abuser.

    The American Academy of Pediatrics has developed a HIPAA tool kit for medical practices with regard to HIPAA rules. This tool kit can be found on their Web site.

    SAN CLEMENTE — Orange County sheriff’s investigators believe a grandmother carried out the murder-suicide in San Clemente that claimed the lives of herself, her daughter and two young granddaughters.

    Elizabeth Fontaine, 38, her daughters Catherine Fontaine, 4, and Julia Fontaine, 2, and their grandmother Bonnie Hoult, 67, were found dead Monday afternoon in a rented home where they were staying in a gated community in the upscale Talega community, said Jim Amormino, a spokesman for the Orange County Sheriff’s Department.

    Amormino said a gun-residue test was inconclusive because Bonnie Hoult and Elizabeth Fontaine died next to one another and the gunpowder residue was found on the hands of both. However. it’s believed that the grandmother likely pulled the trigger.

    Amormino says that a deputy sheriff arrived at the home just moments before the gunshots were fired to do a welfare check. He says that Hoult was outside with her 4 year old granddaughter when she saw the deputy and walked briskly in the house. Within seconds, the deputy heard gunshots inside the home.

    An unidentified sheriff’s homicide investigator told the OC Register what investigators believe happened.

    About 1:30 p.m. Monday, Hoult was outside the home on Calle Sonador, holding Catherine. She was standing next to a black Lexus SUV registered to her daughter in front of the house when a female deputy pulled up.

    Hoult, apparently thinking the deputy was coming to take away the children, bolted into the house through the open garage door. She slammed it and locked the doors to the house.

    Based on what investigators have been able to piece together, they believe that seconds later, while the deputy was standing outside, Hoult – gun in hand – walked up to Elizabeth Fontaine, who was cradling Julia in her arms.

    Hoult put the muzzle in the toddler Julia’s mouth and fired once.

    Fontaine then opened her mouth, and Hoult shot her.

    The grandmother and former schoolteacher then grabbed Catherine and shot her in the mouth.

    All four bodies were found intertwined, just beyond a front door decorated with a Christmas wreath.

    The children’s bags had been packed and were sitting at the bottom of the stairs.

    The gun belonged to Hoult, a retired psychologist, who stayed home with the children while their mother attended a custody hearing.

    Earlier that day, Orange County Superior Court Commissioner Thomas H. Schulte had indicated he would likely grant temporary custody to Fontaine’s sister-in-law and ordered Fontaine to return to court with her daughters in the afternoon for a final ruling, said John York, an attorney for the children’s father, Jason Fontaine.

    When Elizabeth Fontaine failed to show up, York and the children’s father realized there was a 3:30 p.m. flight from John Wayne Airport to Houston and notified the judge, York said.

    Schulte issued a final order granting temporary custody to the paternal aunt and told the aunt to drive to the airport and contact deputies at the sheriff’s substation there, York said.

    Minutes from the hearing confirm that Schulte gave the sister-in-law custody and gave her the authority to contact sheriff’s deputies to help keep the children off the flight.

    The family never went to the airport, however. The bodies were found shortly after 1:30 p.m., the hour they were all due back in court.

    Fontaine moved to Houston last month with the children after a bitter custody dispute in which she repeatedly accused her ex-husband of molesting the two girls.

    A court psychologist interviewed the older daughter, but didn’t find that molestation had occurred, according to court documents.

    The court eventually awarded primary custody to Elizabeth Fontaine, but allowed her ex-husband unmonitored visits.

    Elizabeth Fontaine reopened the custody case in Texas, had the children examined by new psychologists and renewed her allegations of molestation with authorities there, records show.

    Amormino said the children’s father is not a suspect in the case. “The father was nowhere near the crime scene,” he said.

    Amormino said the victims were staying with friends Kevin and Leslie Herbert, who lived in the rented house on the small cul-de-sac with their young son.

    Just an hour before sheriff’s deputies came to the house on Calle Sonador, next-door neighbor Rebecca Vandehei, 43, said she heard a high-pitched cry from what sounded like a young girl and wondered what was going on.

    “It was like someone was waking up from a nap or didn’t like something,” she said.

    Vandehei said Herbert told her that he realized something was wrong, got out of the house and called police.

    “He had heard something that bothered him and told his wife to leave,” Vandehei said. “He heard them talking about some plans and shortly after that police came.”

    The last homicide report in town also involved a family massacre. Relatives who hadn’t heard from relatives broke into a home in another gated community in May 2008 and found five decomposing bodies.

    Authorities said Margrit Ucar, 48, shot her husband and herself, while their 21-year-old twin daughters and the family’s 72-year-old maternal grandmother died from prescription drug overdoses in an apparent suicide pact. The motive has not been determined.

    CINCINNATI — Allegations that workers at a church day care put an over-the-counter dietary supplement in candy to help children sleep at nap time are under investigation, police said Tuesday, and the church’s pastor said two workers have been fired.

    Springfield Township police Lt. Dave Schaefer confirmed that police are looking into allegations that some workers at Covenant Apostolic Church Daycare in suburban Cincinnati gave melatonin to some children there.

    He did not give the ages of the children.

    Police have sent a letter to parents and guardians of children who attend the day care, informing them of the investigation.

    The letter dated Monday says the investigation had just begun and police did not know which staff members allegedly gave the supplement to children or how many of the 40 or so children who attend the day care allegedly received the supplement.

    Laura Satterfield told WCPO-TV that police said employees acknowledged giving her 9-month-old grandson melatonin in his formula to help him sleep better.

    She said he is at the center only one day a week but has had trouble sleeping on visits to her home, including once being awake from 4 a.m. to 5 p.m.

    “He would not sleep,” she told the station. “He would sleep for about five minutes and then he’s up.”

    She said she wants the workers punished.

    “I want these women to be humiliated. I want people to look at these women and say, ‘You gave drugs to kids.”‘

    The letter sent to parents said the information was being provided to parents and guardians so that they could “take whatever actions you deem necessary to protect your child or children in the event that they were given melatonin on one or more occasions.”

    It suggested parents or guardians contact their family physician or the Poison Control Center if they have questions about the effects of melatonin.

    The letter also said the Hamilton County prosecutor’s office had been notified and the day care is cooperating in the investigation.

    Pastor Shelly Hendricks said he discovered on Sunday that some children had been given melatonin by staff members, but he declined to explain how he found out.

    Since then, two staff members have been fired, he said.

    “This should not have occurred,” Hendricks said. “We immediately began to investigate this matter.”

    Hendricks said all parents had been notified about what happened. He would not say how many children were involved or how many times they were given melatonin.

    The day care center has remained open the entire time, he said.

    “The police are satisfied that our day care is being run properly and safely,” he said.

    Schaefer referred calls seeking any additional information to the prosecutor’s office in Cincinnati.

    Prosecutor spokeswoman Julie Wilson said she only could confirm that there was an ongoing investigation into the day care.

    Melatonin is a hormone made by a small gland in the brain. It helps control sleep and wake cycles and is not FDA-approved or regulated, according to the Mayo Clinic Web site.

    Possible side effects include dizziness, abdominal discomfort, headaches, confusion, sleepwalking and nightmares.

    The site also says that long-term effects of melatonin are not known and it may not be safe for anyone who is pregnant, breast-feeding or younger than age 20.

    WEST JORDAN, Utah — A family a four was found dead in their apartment in what police said was an apparent murder-suicide.

    A 36-year-old man and a 31-year-old woman, along with boys ages 6 and 4, were found dead from apparent gunshot wounds Thursday night in a unit at the Willow Cove apartment complex, West Jordan Police Sgt. Drew Sanders said. The names of the family members were not immediately released.

    Officers had begun a search for the family Thursday evening after police in Salt Lake City and Midvale were contacted by individuals who had received text messages from the man at about 7 p.m. The texts indicated the man planned to harm himself and his family, Sanders said.

    No one who received the text messages, however, had an address for the family, Sanders said.

    After a possible address was located on an old police report, West Jordan officers went to the apartment and discovered the bodies around 8:45 p.m., Sanders said.

    He said no one in the apartment complex reported hearing gunshots.

    “Had the people that got the text messages not called police, we still might not know about this,” Sanders said.

    Sanders said the married couple was separated but had no history of domestic violence.

    Parents Arrested After Baby Badly Burned by Heater – COMPTON — The parents of a 6 month old girl were in custody on suspicion of felony child endangerment Tuesday after the child suffered second-degree burns from a heater at a home in Compton.

    The girl’s injuries were reported at 10:44 p.m. Monday at 1706 N. Wilmington Ave., said Compton Fire Department dispatcher.

    Deputies also found narcotics and filthy conditions at the home, the Los Angeles Sheriff’s Department said.

    The girl was hospitalized while her two brothers, ages 2 and 5 years, were turned over to County Child Protective Services, said Lt. Henry Saucedo of the Compton Sheriff’s Station.

    The girl was burned by a portable floor heater, Saucedo said, adding that although the boys were not injured, conditions at the home were not safe for them.

    Minneapolis, Minn (The Weekly Vice) – Aaron F. Biber, a 46-year-old attorney in line to become the president of the Minnesota State Bar association was jailed Friday after he allegedly plied an underage boy with alcohol and then raped him.

    According to police, Biber was in the process of arranging a second sex romp with the young boy while detectives listened in on the conversation.

    “Let’s get this party started,” Biber allegedly told the teen while arranging to meet him Friday at the Eden Prairie Mall. Biber was taken into custody as he arrived at the arranged location.

    According to prosecutors, Biber allegedly gave liquor to and had sexual relations with a 15-year-old boy at his Shorewood home back in October. The sexual activities reportedly included unprotected oral and anal sex.

    Investigators say Biber also sent sexually explicit text messages and photos of his genitals to the teen after the alleged encounter.

    The alleged incidence came to light by way of an anonymous tip that was reported to the South Lake Minnetonka Police Department within the last few weeks. Detectives then recorded a phone conversation between Biber and the boy on Friday, Dec. 11.

    Biber, who is known to many as a past president of the Hennepin County Bar Association and co-chair of the antitrust and trade regulation team at Gray Plant Mooty – shocked colleagues as the news of his arrest spread the community.

    Sarah McCutchen Alleged Teacher From Hell

    Bishopville, South Carolina – Police in Bishopville have charged a former teacher at Bishopville Primary School, Sarah McCutchen, with 16 counts of unlawful conduct with a child. And if these charges are true, this chick was waaaay worse than my second grade teacher.

    She would simply hit your knuckles with a ruler, or use her hand to squeeze your face into “fish lips” as she berated you in front of the entire classroom just because you purposely picked a scab on your elbow to sign your test in blood. McCutchen is much, much worse.

    She has been accused of abusing students between the ages of 4 and 6-years-old by rubbing Purell hand sanitizer in their faces and mouths, striking them with a paint stick stirrer, slapping their faces, and stepping on their hands.

    Ewing said Friday that she may also have twisted the childrens’ hands behind their backs. There are also claims that McCutchen threatened the children, telling them that if they told anyone about the abuse, she would have Department of Social Services take them away from their parents.

    RIO DE JANEIRO — A jailed Brazilian admitted in a television interview that he shoved nearly three dozen sewing needles into his 2-year-old stepson because he wanted to kill the boy to spite his wife.

    Speaking from his cell, 30-year-old bricklayer Roberto Carlos Magalhaes told how he doped the child with wine mixed in water, then stuck needles into his body while his lover held the boy down.

    “I did this two or three times a week during one month,” Magalhaes said in an interview with Globo TV’s “Fantastico” program Sunday from a jail in the northeastern state of Bahia.

    The boy was too drunk from the wine mixture to cry while the needles were being pushed in, but he felt pain after the alcohol wore off, Magalhaes said.

    “It was truly an unbearable suffering,” he said. “It was to get back at the boy’s mother. I thought the needles would work their way through his body and kill the boy. It was a way to kill without anyone discovering.”

    But the pain led the toddler to complain to his mother, and on Dec. 10 she took him to a hospital where X-rays revealed about 30 needles lodged throughout his body.

    The boy underwent a five-hour operation in the northeastern city of Salvador on Friday to remove four rusty needles that most threatened his life, near his heart and in his lungs.

    Doctors said Sunday the child was doing well and would likely undergo two more surgeries, the next one Wednesday at the earliest, to extract needles up to 2 inches (5 centimeters) long from his abdomen and spine.

    Suzy Moreno, a spokeswoman for Hospital Ana Nery, said hundreds of people across Brazil had contacted the facility to inquire about the boy.

    “Many people are coming by to bring Christmas presents,” she said. “Many are also calling us to express their outrage. … The support has been incredible.”

    Along with Magalhaes, police believe his lover, Angelina Ribeiro dos Santos, was also seeking revenge on Magalhaes’ wife.

    The bricklayer told detectives that dos Santos would enter into trances and give him commands to insert the needles, police inspector Helder Fernandes Santana said.

    Magalhaes and dos Santos were both arrested, though no charges had been filed. They were taken to an undisclosed location for their own protection after a mob threw stones at the police station where they were being held.

    Dos Santos is not believed to be a member of any religious or occult group, and authorities believe the pair came up with the idea on their own.

    The boy’s name is not being released because of his age.

So he came up with a brilliant fucking plan – he would slowly kill the woman’s 2-year-old son, his step-son, to spite the woman. Spanning a period of one month, Roberto, with the help of his lover, Angelina Ribeiro dos Santos, and an unnamed Afro-Brazilian priestess, Roberto doped the child with a wine and water mix and pushed sewing needles into his body. Nearly 40 needles, measuring 2-inches long, were pushed into the toddlers neck, legs, and torso. “I did this two or three times a week during one month,” the sadistic bastard admitted. “It was to get back at the boy’s mother. I thought the needles would work their way through his body and kill the boy. It was a way to kill without anyone discovering.” The child’s mother had him seen at a hospital on December 10th – it was then that X-rays revealed the needles. The boy underwent a five-hour operation on Friday (Friday reviews) to remove four rusty needles that were an immediate threat his life, near his heart and in his lungs. And it ain’t over yet – he will require at least 2 more surgical procedures to remove needles from his abdomen and spine. Roberto and his mistress have been arrested, but charges haven’t been filed as of yet. After their arrest, they had to be moved to an undisclosed location after a mob threw stones at the police station where they were being held. Damn. Hand ‘em over to the angry mob, would ya?
